Salvadoran migrant Kilmar Abrego Garcia has been released from federal custody in Tennessee and is on his way back to his family in Maryland. However, his legal battle is far from over. Abrego Garcia, who was charged with transporting illegal migrants in the United States, will be under the supervision of Immigration and Customs Enforcement until his trial in January 2026. The investigation leading to these charges began during his detention in El Salvador, prompting questions about the nature of the probe.
As part of his release conditions from Putnam County Jail, Abrego Garcia will wear a monitoring device and must remain in Maryland. The Justice Department had opposed his release, citing him as a danger to the community. Abrego Garcia’s lawyers have filed a motion to dismiss the criminal charges filed by the Trump DOJ.
A judge in Maryland recently blocked ICE from deporting Abrego Garcia immediately upon his release from jail. The administration must now provide a 72-hour notice period before initiating any deportation proceedings, allowing Abrego Garcia access to his legal counsel and the opportunity to challenge his removal to a third country.
Abrego Garcia was previously deported to El Salvador in violation of a court order in 2019, which the Trump administration later admitted was an error. He had been living in Maryland with his family for over a decade before his deportation.
His attorneys argue that the prosecution in Tennessee is selective and vindictive, citing remarks from judges overseeing the case. They are seeking to have the charges against Abrego Garcia dismissed on these grounds.
