Appeals court to review Trump bid to avoid returning deported Venezuelan migrant

The case at hand involves Daniel Lozano-Camargo, a young Venezuelan national who was deported to El Salvador in March as part of the Trump administration’s crackdown on immigration. U.S. District Judge Stephanie Gallagher, a Trump appointee, ruled last month that the deportation violated an agreement between the Department of Homeland Security (DHS) and a group of young asylum seekers, including Lozano-Camargo. Under this agreement, DHS had promised not to deport these individuals until their asylum requests were fully reviewed by U.S. courts.

Judge Gallagher deemed Lozano-Camargo’s deportation a breach of contract since his asylum case had not been heard. She ordered the U.S. government to facilitate his return to the United States. However, the Justice Department argued that Lozano-Camargo was eligible for removal under the law due to a prior arrest and conviction for cocaine possession in Houston earlier this year. The department also claimed that he was a member of a violent terrorist gang, although specifics were redacted from court documents.

Despite these claims, Judge Gallagher emphasized that her decision was based on due process protections, not the strength of Lozano-Camargo’s asylum request. She stressed the importance of following proper legal procedures and ensuring fair treatment for all individuals involved in the case.
