DOJ sues Minnesota over in-state tuition benefits for illegal immigrants

The Department of Justice (DOJ) has taken legal action against the state of Minnesota, challenging laws that provide free and reduced in-state tuition to illegal aliens. The DOJ argues that these laws are unconstitutional as they violate federal law, which prohibits higher education institutions from offering benefits to illegal aliens that are not available to U.S. citizens.

Attorney General Pam Bondi stated, “No state can be allowed to treat Americans like second-class citizens in their own country by offering financial benefits to illegal aliens.” The DOJ recently succeeded in a similar case in Texas, and they are now turning their attention to Minnesota to protect the rights of American citizens.

The lawsuit filed by the DOJ demands that Minnesota cease enforcing a law that requires public colleges and universities to offer in-state tuition rates and free tuition to illegal immigrants who maintain state residency. This action is in response to two executive orders signed by President Donald Trump, aimed at preventing illegal immigrants from receiving taxpayer benefits or preferential treatment.

One of the executive orders, “Ending Taxpayer Subsidization of Open Borders,” directs agencies to ensure that no taxpayer-funded benefits go to unqualified aliens. The other order, “Protecting American Communities From Criminal Aliens,” instructs officials to halt the enforcement of state and local laws that favor aliens over American citizens.

In a similar case, Texas complied with the DOJ’s demands to stop enforcing the Texas Dream Act, which allowed certain illegal immigrants to pay in-state tuition at public colleges and universities. However, the ACLU of Texas has intervened to defend the constitutionality of the Texas Dream Act against the DOJ’s actions.
