Suspended sentence, time served, probation

Nathan Malcolm Cox, 38, of Wolfville, has been given a suspended sentence for failing to comply with probation by not making a refund. Cox has also been sentenced to served time and probation on three more charges of non-compliance with probation; making a threat to cause bodily harm; failure to comply with a condition of an undertaking; failure to comply with a condition of a release order; knowingly making a death threat over the telephone; and guarding the home of a person without legal authority.

Cox pleaded guilty to one charge of failing probation on May 3 and changed his plea to guilty to an additional seven charges on May 8. and for sentencing.

Cox was present in provincial court, in custody, on June 8. Judge Alan Tufts sentenced Cox to one month in jail, deemed to have been served on the first charge of failing to comply with probation. Cox was sentenced to three months’ detention, deemed to have served time for failing to comply with a condition of an undertaking and a second time for failing to comply with probation.

Cox was sentenced to three months’ detention, deemed to have served time, for each of the following charges: making a threat to inflict bodily harm; failure to comply with a condition of a release order; making a death threat over the telephone; the third count of non-compliance with the probationary period; and for guarding a property without legal authority.

Cox was also sentenced to two years of probation on the eight charges. The court imposed a 10-year gun ban on Cox and granted a secondary DNA warrant on the two charges of making threats and guarding a residence without legal authority.

Cox pleaded guilty to the charge of failing to comply with probation by failing to issue a refund on June 8. He was given a six-month suspended sentence, with the condition of repaying $893.15 to an individual.

Cox committed the Kentville offenses between March 10, 2022 and March 9, 2023; and between September 22, 2022 and January 18, 2023; and in Wallbrook between December 20, 2022 and January 1, 2023; and on January 11, 2023.

Allegations of knowingly conveying a death threat over the telephone; making a threat over the phone to set someone’s house on fire; and making repeated calls to a person with intent to harassment were rejected on June 8.

Conditional discharge for car theft

Ted Byron Evan Gillis, 45, of no fixed address, has been released on probation for stealing a motor vehicle, a green 1999 Acura, in which he committed theft.

Gillis changed his plea to guilty on March 28. The case was adjourned until June 7 to allow time for an official report and sentencing. Judge Ronda Van Der Hoek gave Gillis a conditional discharge with 12 months’ probation.

Gillis committed the offense in East Kingston on September 1, 2021.

Fined for driving under the influence

Elizabeth Erin Tellier, 43, of Coldbrook, has been fined for operating a vehicle when her ability to operate it was impaired to some degree by alcohol or a drug or both.

Tellier changed her plea to guilty on June 7. Judge Ronda Van Der Hoek fined Tellier $1,500 and banned her from driving for two years.

Tellier committed the crime in Coldbrook on May 22, 2022. The legal blood alcohol limit is 80mg of alcohol in 100ml of blood. Tellier gave blood alcohol values ​​of 200 and 190.

A charge of having a blood alcohol concentration equal to or greater than the legal limit within two hours of stopping driving a mode of transportation was dropped on June 7.

Intimidation, offense committed

Bradford Leigh Benjamin, 30, of Kentville, has been paroled on probation for committing criminal harassment by repeatedly communicating directly or indirectly with an individual; and for failure to comply with a condition of an undertaking.

Benjamin pleaded guilty to the charges on March 28. The cases were adjourned until June 7 to allow time for an official report to be drawn up and sentencing.

Judge Ronda Van Der Hoek gave Benjamin a conditional discharge with 18 months’ probation on the two charges. The court granted a secondary DNA warrant and imposed a two-year discretionary firearms ban on Benjamin.

Benjamin committed the offenses in New Minas on November 14, 2022 and in Kentville on January 11, 2023.

Conditional discharge for harassment

Alexandra Jordan MacEachern, 34, of Berwick, has been released on probation for repeatedly communicating directly or indirectly with an individual, which caused the individual to reasonably fear for their safety, leading them to commit criminal harassment.

MacEachern pleaded guilty to the charge on April 19. The case was adjourned to June 12 to allow time for a pre-sentencing report to be prepared and sentencing. Judge Ronda Van Der Hoek gave MacEachern a conditional discharge with 15 months’ probation.

MacEachern committed the offense between February 2020 and December 2022 in Kings County.

Probation Violation

Denice Louise Noseworthy, 44, of Meadowvale, has been sentenced to a suspended sentence and probation for failing to comply with a probation order, not to have direct or indirect contact or communication with any person, except under certain circumstances.

Noseworthy pleaded guilty to the charge on April 19. The case was adjourned to June 7 to allow time for a pre-sentence report and sentencing.

Judge Ronda Van Der Hoek sentenced Noseworthy to one day’s detention and 10 months’ probation.

Noseworthy committed the offense in Greenwood on October 4, 2022.
