DOJ accuses Rep McIver of assaulting federal agents during ICE facility visit

The Department of Justice has recently accused Rep. LaMonica McIver of assaulting two federal agents at the Delaney Hall Detention Facility in New Jersey. The incident, which took place last month, has sparked controversy and led to a new charging document being filed against McIver.

According to the charging document, bodycam footage from law enforcement officers captured the events as McIver and two other New Jersey lawmakers stormed the ICE facility. The prosecutors claim that McIver allegedly assaulted a Homeland Security Investigations agent and an ICE agent during the altercation.

The document alleges that McIver “slammed her forearm into the body of a uniformed HSI agent and reached out and tried to restrain the agent by forcibly grabbing him.” Additionally, it states that McIver “pushed an ICE officer and used her forearms to forcibly strike the agent.”

In response to the charges, McIver released a public statement denying the allegations and labeling them as “purely political.” She emphasized that she and her colleagues were simply fulfilling their lawful oversight responsibilities when they visited the facility. McIver criticized the ICE agents for creating an “unnecessary and unsafe confrontation” by choosing to arrest Newark Mayor Ras Baraka during their visit.

Prosecutors claim that McIver helped create a “human shield” to block agents from handcuffing Mayor Baraka after he ignored warnings to leave the property. The charging document details how McIver intervened when the HSI agent attempted to arrest the mayor, shouting “Hell no! Hell no! Hell no!” and physically preventing the agent from handcuffing Baraka.

Department of Homeland Security (DHS) Secretary Kristi Noem has weighed in on the situation, emphasizing that “no one is above the law.” She commended the ICE law enforcement officers for their service and stated that individuals who assault law enforcement officers will be prosecuted to the fullest extent of the law.
