FBI must release Mar-a-Lago probe records despite Trump’s criminal immunity: Judge

The FBI is set to release records from the Mar-a-Lago classified documents probe, despite the case against President Donald Trump being dismissed due to his presidential immunity. This ruling came from U.S. District Judge Beryl Howell, who determined that more information related to the case must be disclosed by Feb. 20.

Journalist Jason Leopold initiated a Freedom of Information Act (FOIA) case after reports surfaced that Trump had potentially mishandled presidential records during his time in office. The FBI initially sought to withhold the records under Exemption 7A, which protects law enforcement information from being released if it could interfere with enforcement proceedings.

However, Judge Howell’s decision stated that since Trump is immune from criminal proceedings, the documents can still be made public as there are no active enforcement actions against him. This means that even though Trump himself is protected, individuals who may have assisted in criminal actions are not shielded by his immunity.

The court’s ruling also highlighted the importance of holding accountable those who aid, abet, or execute criminal acts on behalf of a president with immunity. Judge Howell emphasized that the excuse of “just following orders” is not a valid defense in the American legal system, drawing a parallel to the rejection of such excuses after World War II.

Moving forward, a schedule will be proposed to conclude the case promptly, as both parties are directed to submit a joint status report by February 20, 2025. Despite the legal complexities surrounding presidential immunity, the decision ensures that transparency and accountability remain paramount in matters of national security and law enforcement.
