Federal judge shuts down Trump refugee suspension in major blue city

A federal judge has recently blocked the Trump administration’s attempt to suspend refugee admissions into the United States following a lawsuit from refugee aid groups. President Donald Trump had signed an executive order on his first day in office to suspend refugee resettlement and directed the Department of Homeland Security to assess whether resuming resettlement would be in the country’s best interests.

However, District Judge Jamal Whitehead, a Biden appointee, deemed Trump’s actions as an “effective nullification of congressional will” in establishing the nation’s refugee admissions program. Whitehead emphasized that while the president has discretion to suspend refugee admissions, this authority is not limitless.

The case was brought forth by refugee groups such as the International Refugee Assistance Project, HIAS, Lutheran Community Services Northwest, and individual refugees. These groups argued that the Trump order had impeded their ability to provide services to refugees.

The order was part of a series of measures aimed at restricting both illegal and legal immigration, including the use of parole to admit migrants under the Biden administration. Trump had limited refugee resettlement during his tenure, whereas President Joe Biden sought to increase the refugee cap and welcome more refugees into the country.

Trump justified his executive order by stating that the U.S. lacks the capacity to absorb large numbers of migrants and refugees without compromising resources, safety, security, and proper assimilation. He suspended the U.S. Refugee Admissions Program (USRAP) until the entry of refugees aligns with the nation’s interests.

The plaintiffs contended that the suspension violated federal law and should have undergone the notice-and-comment period outlined in the Administrative Procedures Act. They also argued that the suspension and funding cut were arbitrary and capricious.

The recent ruling serves as a setback for the Trump administration, especially after a federal judge declined to block the suspension in a separate case brought by the U.S. Conference of Catholic Bishops.
