Federal judge strikes down Biden-era admin nursing home staffing rule

A federal judge in Texas recently made a significant ruling regarding a national mandate on nursing home staffing that was implemented during the Biden administration. U.S. District Judge Matthew J. Kacsmaryk sided with nursing homes in a decision that struck down a rule requiring them to increase nursing staff to meet minimum staffing to patient ratios.

In his ruling, Judge Kacsmaryk stated that the Center for Medicare and Medicaid Services did not have the authority to disregard a facility’s nursing needs when establishing minimum staffing standards. The American Health Care Association (AHCA), which represents around 15,000 nursing homes and long-term care facilities in the United States, was one of the plaintiffs in the case.

AHCA’s President and CEO, Clif Porter, expressed relief at the court’s decision, stating that the unrealistic staffing mandate could have potentially led to the closure of nursing homes and the displacement of vulnerable seniors. Porter called on Congress to take action, emphasizing the importance of promoting innovation and high-quality outcomes in the long-term care industry.

According to Judge Kacsmaryk’s ruling, the majority of nursing homes in the U.S. participate in Medicare and Medicaid, subjecting them to a consolidated set of regulations. Porter reiterated AHCA’s commitment to growing their workforce and improving care for residents, despite facing resource limitations.

Prior to the introduction of the staffing mandate, AHCA had been working on various workforce solutions to attract new caregivers to the long-term care sector and enhance their skills and career development. The organization believes that federal policymakers should focus on supporting these initiatives rather than imposing rigid staffing requirements.
