House looking at action to rein in federal judges amid Trump restraining orders

House Speaker Mike Johnson, R-La., and Republicans in the lower chamber are currently exploring various tools available to combat what they see as the threat posed by “activist judges” who they believe are obstructing President Trump’s agenda. A spokesperson for Johnson’s office stated, “Activist judges with political agendas pose a significant threat to the rule of law, equal justice, and the separation of powers. The Speaker looks forward to working with the Judiciary Committee as they review all available options under the Constitution to address this urgent matter.”

The House’s consideration of potential actions to rein in the federal judiciary comes in response to a recent decision by U.S. District Judge James Boasberg to temporarily halt the administration’s deportation flights of illegal immigrants. The emergency order was granted to review the 1798 wartime-era Alien Enemies Act, which the administration was using to immediately deport Venezuelan nationals and alleged members of the violent gang Tren de Aragua.

President Trump expressed his frustration with Judge Boasberg’s order, suggesting impeachment for the judge. He took to social media to voice his disapproval, stating, “This judge, like many of the Crooked Judges I am forced to appear before, should be IMPEACHED!!! WE DON’T WANT VICIOUS, VIOLENT, AND DEMENTED CRIMINALS, MANY OF THEM DERANGED MURDERERS, IN OUR COUNTRY. MAKE AMERICA GREAT AGAIN!!!”

In a separate post, Trump emphasized the importance of the President’s authority to enforce immigration laws, criticizing what he perceived as judicial overreach. He stated, “If a President doesn’t have the right to throw murderers, and other criminals, out of our Country because a Radical Left Lunatic Judge wants to assume the role of President, then our Country is in very big trouble, and destined to fail!”

Republicans have been vocal in their criticism of the numerous temporary restraining orders issued against the Trump administration by judges nationwide. White House Deputy Chief of Staff for Policy and Homeland Security Advisor Stephen Miller condemned what he referred to as “naked judicial tyranny,” questioning the extent of power wielded by individual judges in comparison to the President.

As the House explores potential avenues to address the issue of activist judges, the Senate is also expected to delve into the matter. The Senate Judiciary Committee is slated to hold a hearing on the subject in the coming weeks, further underscoring the importance of addressing judicial activism.
