Human smuggling incident gone wrong results in three deaths, one missing child

The U.S. Attorney’s Office for the Southern District of California has brought charges against five individuals in connection with a tragic human smuggling incident that resulted in the deaths of at least three people, including a 14-year-old boy from India. The incident occurred when a panga boat overturned at a beach in Del Mar, California, on Monday, prompting rescue efforts by bystanders, San Diego lifeguards, and law enforcement officials.

Tragically, three individuals lost their lives in the incident, including the 14-year-old boy, identified as “P.P.B.” in court records. The boy’s mother, father, and two others were rescued and hospitalized, with the father currently in a coma. Regrettably, the boy’s 10-year-old sister remains missing at sea and is presumed dead.

Two Mexican nationals, Julio Cesar Zuniga Luna, 30, and Jesus Juan Rodriguez Leyva, 36, were arrested at the scene and now face charges of bringing in aliens resulting in death and bringing in aliens for financial gain. The severity of the charges means they could potentially face death sentences or life in prison, along with hefty fines. Additionally, U.S. Border Patrol agents were able to identify two vehicles involved in the smuggling operation, leading to the apprehension of the drivers and the recovery of eight of the remaining nine migrants, leaving only the 10-year-old child unaccounted for.

The U.S. Attorney’s Office also charged three Mexican nationals – Melissa Jenelle Cota, 33, Gustavo Lara, 32, and Sergio Rojas-Fregosa, 31 – with transportation of illegal aliens. These individuals face maximum sentences of ten years in prison and fines of up to $500,000. Rojas-Fregoso, who had been deported in 2023, faces an additional two years in prison and a $250,000 fine.

In response to this tragic incident, U.S. Attorney Adam Gordon emphasized the callous disregard that human traffickers have for human life, stating that “the drowning deaths of these children are a heartbreaking reminder of how little human traffickers care about the costs of their deadly business.” Special Agent Shawn Gibson of HSI San Diego echoed this sentiment, emphasizing the urgent need to dismantle criminal networks driven by greed.

Human smuggling is a dangerous and illegal practice that puts lives at risk, and law enforcement agencies are committed to holding those responsible for such tragedies accountable. The collaborative efforts of HSI, the U.S. Border Patrol, U.S. Coast Guard, and other partners are focused on preventing further loss of life and bringing justice to those involved in these senseless deaths.
