Judge scolds Trump administration for delays in Abrego Garcia deportation case

A federal judge in Maryland has scolded Trump administration lawyers for their lack of preparation and last-minute request for an extension in the case of Kilmar Armando Abrego Garcia, a Salvadorian migrant and alleged MS-13 member who was deported to El Salvador due to an administrative error. U.S. District Judge Paula Xinis denied the Justice Department’s 30-day extension request, criticizing the government’s delay in filing and lack of effort in complying with her earlier orders.
Judge Xinis expressed frustration with the administration’s failure to provide the necessary information in the case, despite multiple court hearings and previous orders to facilitate Abrego Garcia’s return to the U.S. The Supreme Court had previously instructed the Trump administration to assist in bringing him back to the country. However, the administration’s repeated delays and incomplete responses have raised concerns about their compliance with the court’s directives.
Following Xinis’ denial of the extension request, the Trump administration filed a motion to dismiss the case, citing a “lack of jurisdiction.” This move comes amidst a prolonged legal battle over Abrego Garcia’s status, with the migrant still remaining in El Salvador. The court has been grappling with the interpretation of what it means to “facilitate” his return, with Judge Xinis criticizing the government’s evasive and incomplete responses during the discovery process.
The ongoing feud between Trump officials and the courts over the use of the Alien Enemies Act, a 1798 immigration law, has further complicated the situation. The administration’s insistence on Abrego Garcia’s affiliation with MS-13, without concrete evidence, has added to the contentious nature of the case. Judge Xinis has expressed growing impatience with the government’s handling of the matter, questioning their compliance with court orders and submission of requested information.
It remains to be seen whether Judge Xinis will pursue contempt proceedings against the administration for their non-compliance with court orders. The lack of transparency and cooperation from the Trump officials has raised concerns about the administration’s adherence to legal directives in deportation cases. The court’s scrutiny of the government’s actions underscores the importance of upholding due process and ensuring justice for individuals caught in the immigration system.
