Law enforcement group praises passage of Social Security Fairness Act

Last week, Congress narrowly avoided a partial government shutdown and instead focused on addressing cuts in Social Security for some public sector workers. The Senate passed the Social Security Fairness Act, a bipartisan legislation that repealed two rules – the Windfall Elimination Provision (WEP) and Government Pension Offset (GPO). These rules, put in place in 1980, reduced benefits for public employees receiving state pensions.

The bill, which was sent to President Biden for approval, received overwhelming support in both the House and the Senate. Around 3 million retired firefighters, police officers, teachers, and other public sector workers stand to benefit from this legislation. Mick McHale, president of the National Association of Police Organizations, praised the bill for rectifying a longstanding issue that penalized public sector workers in the area of pensions.

Public sector workers such as firefighters, police officers, postal workers, and teachers who also receive pension payments have been receiving reduced Social Security benefits due to the WEP. The GPO, on the other hand, adjusts spousal benefits based on income from public pensions to prevent overpayments in Social Security.

Senator Susan Collins, R-Maine, who led the measure, highlighted the victory for thousands of teachers, first responders, and public servants in Maine who have had to forego their earned retirement benefits due to the existing rules.

Despite criticism from opponents who argued that the legislation would worsen Social Security’s financial situation, Congress overwhelmingly supported the change. Critics pointed out that the bill would add $196 billion to the federal deficit over the next decade, according to the Congressional Budget Office.

Senator Mike Lee, R-Utah, called the bill “fundamentally unfair” as it would impact millions of workers who have contributed to Social Security. However, supporters of the bill, like Mick McHale, emphasized the importance of rectifying the unfair treatment of public sector workers in terms of Social Security benefits.

The new legislation aims to ensure that public sector retirees receive their full Social Security benefits, without the reductions imposed by the WEP and GPO. It acknowledges the years of service put in by these individuals and seeks to provide them with the retirement benefits they deserve.
