Legal expert reveals why centuries-old law is crucial for Trump admin in immigration fight

As the Alien Enemies Act continues to be a focal point of the immigration debate in the early days of President Donald Trump’s second term, Republican attorney Mehek Cooke shed light on why the White House is utilizing the 1798 law.

Cooke explained that the act allows the administration to detain, apprehend, and deport alien enemies. This has enabled President Trump to expedite the removal of individuals from Venezuela and gang members, particularly those affiliated with MS-13 and Tren De Aragua, both designated as foreign terrorist organizations by the administration.

Recently, U.S. District Judge James Boasberg raised concerns about public comments made by Trump and other officials regarding deportation proceedings under the Alien Enemies Act. He even suggested the possibility of relocating some migrants to Guantánamo Bay. Cooke emphasized that the debate over due process revolves around who is entitled to these rights in the U.S.

She highlighted the different levels of due process afforded to American citizens, illegal aliens, and terrorists, asserting that expedited removal is necessary for individuals like Tren de Aragua members. Cooke lamented that some federal judges are challenging the president’s authority to designate alien enemies and are advocating for terrorists to receive due process.

In a bid to expedite deportations and enhance national security, the Trump administration has faced criticism and legal challenges over its use of the Alien Enemies Act. The ongoing debate underscores the complex intersection of immigration policy, national security concerns, and constitutional rights.

Cameron Arcand, a politics writer at Fox News Digital, contributed to this report, which highlights the ongoing legal battles and policy implications surrounding the Alien Enemies Act in the context of the Trump administration’s immigration agenda.
