Menendez brothers case receives another opposition to recuse DA office from case

California Attorney General Rob Bonta is standing firm against the defense team of Erik and Lyle Menendez’s request to disqualify the Los Angeles District Attorney’s office from their resentencing case. The Menendez brothers’ attorneys have alleged bias and violations of Marsy’s Law against their family by the DA’s office. In response to the defense’s claims, the AG’s office filed a 22-page opposition this week.

The AG’s office asserted that the defense failed to provide evidence that meets the stringent standards required for an office-wide recusal of the DA. They argued that the transfer of two members of the office who previously supported resentencing does not establish an office-wide conflict of interest. Additionally, they noted that any potential conflict arising from one attorney’s previous representation of Kitty Menendez’s brother has been properly addressed by walling her off from the case.

The opposition from the AG’s office comes after the DA’s office filed its own response, labeling the defense’s recusal request as a “drastic and desperate step.” Los Angeles District Attorney Nathan Hochman argued that the Menendez brothers are seeking recusal simply because they disagree with the DA’s stance on resentencing.

Attorney Mark Geragos, representing the Menendez brothers, had previously filed a motion urging Hochman to recuse himself due to a conflict of interest. Geragos claimed that the DA’s view on resentencing, which discounts the brothers’ history of sexual abuse, is incompatible with the possibility of rehabilitation.

The Menendez brothers have been seeking resentencing, claiming unfair conviction to life in prison for the murder of their parents in 1989. Their supporters argue that the brothers were motivated by the alleged sexual abuse they suffered at the hands of their parents. The upcoming hearing, scheduled for Friday, will determine whether the brothers will be resentenced, potentially leading to a review by the state parole board.
