Red state bill seeks to force local compliance with federal immigration law

The Indiana House Judiciary Committee recently voted to advance a bill that would grant the governor authority to penalize local governments that do not comply with federal immigration authorities. The bill, known as Indiana House Bill 1531, passed through the committee on a party-line vote after hours of intense testimony and is now headed to the full House for further consideration.

This bill would empower local law enforcement agencies to enforce federal immigration laws and threaten to withhold funding from local governments that fail to cooperate with federal immigration authorities. Additionally, the bill would authorize the state’s attorney general to impose civil penalties on local government agencies that do not comply with federal immigration detention requests. It also mandates that state judges report any non-U.S. citizen convicted of a crime to federal authorities, prohibits employers from recruiting or hiring illegal immigrants, and provides immunity to government bodies or employees for actions taken on immigration detainer requests.

Assistant Chief Deputy Attorney General Blake Lanning explained that existing labor trafficking laws were insufficient in addressing the issue of illegal immigrants being employed in the state. Working closely with the state’s GOP legislature, the attorney general’s office crafted the bill in response to non-compliance with federal immigration orders by local jurisdictions. Republican Attorney General Todd Rokita had previously threatened to sue jurisdictions that did not adhere to federal immigration orders.

President Donald Trump’s administration has been focused on enhancing border security and deporting undocumented immigrants. However, efforts have been impeded by sanctuary jurisdictions that prohibit local law enforcement agencies from cooperating with federal immigration authorities. Indiana’s proposed legislation has faced opposition from Democrats and advocacy groups who question its constitutionality.

Carolina Castoreno, co-founder of the Alliance for Latino Migrant Advocacy, criticized the bill as anti-immigrant and racist, highlighting the discriminatory rhetoric used during discussions. Despite opposition, the bill is likely to pass in Indiana, where Republicans hold supermajorities in the state House of Representatives and Senate, as well as control the governor’s office.

The contentious debate over immigration enforcement continues to be a divisive issue in Indiana and across the country. The passage of Indiana House Bill 1531 would mark a significant step towards stricter immigration enforcement in the state.
