40 Days for Life activist Mark Houck discusses new appeal in his battle against an ‘activist’ judge

Pro-life activist Mark Houck, who recently sued the Justice Department over his arrest and prosecution under the Biden administration, is facing roadblocks in settling his lawsuit due to what he calls an “activist” federal judge. Houck, who filed the lawsuit last year, is seeking restitution for what he claims was a faulty investigation and excessive force used during his arrest in front of his children by a SWAT team of around 25 people.

Houck, along with his wife and 40 Days for Life founder Shawn Carney, discussed the case in a video shared exclusively with Fox News Digital. In the video, Houck expressed his fear of a potential repeat incident and called on the Trump administration to put an end to the weaponization of the DOJ against pro-life activists like himself.

40 Days for Life President Shawn Carney expressed frustration with activist judges on both sides of the political aisle and emphasized the need for the Justice Department to address the issue. The group has already filed a Notice to Appeal with the courts on behalf of Houck, aiming to challenge the dismissal of the case by U.S. District Judge Paul Diamond, a Bush appointee.

The settlement negotiations between 40 Days for Life and the Justice Department were abruptly ended when Judge Diamond issued a motion to dismiss the case last month. The Biden-led Justice Department had initially filed the motion, charging Houck with violating the Freedom of Access to Clinic Entrances Act.

Despite the setback, Carney remains confident in the appeal process and is hopeful that the Trump administration will rectify the situation. He criticized Judge Diamond for what he perceived as political bias and activism in his decision.

Houck, a dedicated volunteer with 40 Days for Life since 2007, was arrested in 2021 for his actions outside a Planned Parenthood clinic. He was acquitted by a Philadelphia jury but faced the possibility of a lengthy prison sentence if convicted.

Following his acquittal, Houck and 40 Days for Life filed a lawsuit against the Justice Department, alleging a faulty investigation and excessive use of force during the FBI raid of his family home. The appeal of the dismissal of the case is currently in progress, with Carney expressing confidence in a positive outcome.

The FBI and Department of Justice have not provided comments on the matter. As the legal battle continues, Houck and his supporters remain steadfast in their fight for justice and accountability within the Justice Department.
