Trump administration asks Supreme Court to review El Salvador deportation flight case

The Trump administration is facing legal challenges in its attempt to use an 18th-century wartime immigration law to immediately deport Venezuelan nationals, including alleged members of the gang Tren de Aragua, from the United States. The administration recently asked the Supreme Court to review a restraining order that temporarily blocks their use of the Alien Enemies Act for deportation purposes.
This move comes after the DC Circuit Court of Appeals upheld a lower court’s decision to temporarily block the administration from using the law for a 14-day period. The court’s ruling was based on concerns of due process violations and the potential for immediate and irreparable harm to the plaintiffs. In their appeal to the Supreme Court, Acting Solicitor General Sarah Harrmis argued that the lower court’s orders threaten the government’s negotiations with foreign powers and risk serious harm if not immediately reviewed. The administration is requesting an administrative stay to continue using the Alien Enemies Act while the case is considered by the high court.
