Trump files motion to stay sentencing in New York case

President-elect Donald Trump has taken legal action to delay his sentencing in the New York v. Trump case, according to a report from Fox Digital. The motion to stay the Jan. 10 sentencing was filed by Trump’s legal team, citing the Supreme Court’s decision on Immunity, the state constitution of New York, and established legal precedent as reasons for dismissing the case.

In a statement to Fox Digital, Trump’s spokesman and incoming White House communications Director Steven Cheung stated, “Today, President Trump’s legal team moved to stop the unlawful sentencing in the Manhattan D.A.’s Witch Hunt. The Supreme Court’s historic decision on Immunity, the state constitution of New York, and other established legal precedent mandate that this meritless hoax be immediately dismissed.”

The sentencing date was set by New York Judge Juan Merchan earlier this month, just days before Trump’s scheduled presidential inauguration on Jan. 20. Trump is slated to appear in court for sentencing on Friday, Jan. 10 at 9:30 a.m.

The case stems from Trump being found guilty of 34 counts of falsifying business records in Manhattan. The Manhattan District Attorney’s office alleged that Trump falsified records to conceal a $130,000 payment to former porn star Stormy Daniels in an effort to silence her claims of an alleged affair with Trump in 2006.

Throughout the legal proceedings, Trump has maintained his innocence and criticized the case as a politically motivated attack orchestrated by Democrats to undermine his presidential campaign. In a post on Truth Social, Trump denounced the case as part of a larger pattern of “New York Judicial and Prosecutorial Witch Hunts” against him.

The legal battle has been a focal point of Trump’s defense, with the former president asserting that the case is baseless and part of a broader effort to target him unfairly. As the sentencing date approaches, the outcome of the case remains uncertain, with Trump’s legal team fighting to have the charges dismissed.

As the saga continues to unfold, Trump’s supporters and critics alike are closely watching the developments in the New York v. Trump case. The legal battle has become emblematic of the contentious relationship between Trump and the justice system, with implications that could reverberate well beyond the courtroom.
