In a letter to Judge Juan Merchan, Trump’s defense attorney Todd Blanche argued that the American people’s choice to elect Trump to a second term supersedes Bragg’s alleged political motivations.

Blanche demanded that the case against Trump be tossed, citing the mandate issued by the nation’s people in the 2024 Presidential Election. He emphasized that the case must be dismissed to facilitate the orderly transition of executive power following Trump’s overwhelming victory. Blanche also highlighted Bragg’s own reelection campaign as Manhattan district attorney, questioning the motives behind the prosecution.

The letter from Trump’s legal team sought permission to file a motion to dismiss by a certain date and requested a stay on all deadlines. Blanche argued that continuing with the case would be destabilizing and could hamper governmental operations both domestically and internationally. He urged the court to address these new issues and dismiss the case to uphold the presidential immunity doctrine and the Supremacy Clause.

Bragg, on the other hand, requested a stay on the case until 2029, indicating his opposition to Trump’s motion to dismiss but willingness to consider the defense’s arguments. The case stems from charges related to alleged hush money payments and falsifying business records, with Trump pleading not guilty to all counts.

The defense team also raised concerns about the admission of certain evidence during the trial, arguing that it pertained to official acts and should not have been considered. Blanche contended that the use of such evidence violated the presidential immunity doctrine and called for the charges to be dismissed.
