The federal judge overseeing Hunter Biden’s gun trial made a significant decision on Tuesday to terminate all further court proceedings in his case. This decision comes in the aftermath of President Joe Biden’s sweeping pardon that shields his son from prosecution for any offenses he may have committed between Jan. 1, 2014, and Dec. 1, 2024.
U.S. Judge Maryellen Noreika, who presided over Hunter Biden’s trial in Delaware, announced the termination of all future proceedings in the case, citing the clemency grant signed by President Biden. However, Judge Noreika did not dismiss the case outright, as requested by Hunter’s legal team.
Earlier this summer, a Delaware jury found Hunter guilty on all three federal felony firearm charges brought against him by prosecutors. His sentencing date had been scheduled for Dec. 12 before the sweeping pardon was announced.
President Biden, in announcing the pardon, criticized the investigation and prosecution of his son, calling it unfair and politicized, leading to a “miscarriage of justice.” He stated that the process was tainted by politics and that Hunter was unfairly targeted because of his relationship with the President.
Despite the President’s defense of the pardon, some critics pointed out that it contradicted Biden’s longstanding promise not to pardon his family members and could further damage the public’s perception of the Justice Department.
The pardon also covers tax evasion charges that Hunter pleaded guilty to in California. The decision to pardon Hunter raised questions about the limits of executive power and the potential implications for future cases involving public officials’ family members.
In a separate case involving tax evasion charges, Judge Mark Scarsi has not yet announced whether he will terminate proceedings against Hunter or dismiss the case entirely.
