US equal opportunity commission demands 20 law firms disclose DEI employment practices

The U.S. Equal Employment Opportunity Commission (EEOC) is taking action to increase diversity, equity, and inclusion in the workplace by requesting data from 20 law firms. This move comes as the federal agency warns that some employment practices may be in violation of Title VII of the Civil Rights Act of 1964, which prohibits discrimination based on race, color, religion, sex, and national origin.

Acting chair of the EEOC, Andrea Lucas, sent letters to the firms seeking detailed information on their DEI programs. Some of the law firms have connections to President Donald Trump’s political opponents and have challenged his policies targeting DEI. Lucas expressed concern that some firms may be engaging in unlawful practices that discriminate based on race, sex, and other protected characteristics.

The letters requested information on the internships, scholarships, and fellowships offered by the firms, as well as their hiring and compensation practices. Lucas also asked for the demographic information of every lawyer who has worked at or applied for a job at the firms since 2019, and whether they participated in diversity programs.

The EEOC has the authority to investigate companies’ employment practices and file lawsuits over allegations of discrimination. However, it is unclear if formal complaints have been filed against any of the firms in question. President Trump has been vocal about eliminating DEI programs across various sectors, including the federal government and private sector.

Trump has also issued executive orders targeting specific law firms over their alleged discriminatory practices. This includes revoking security clearances and restricting government access for lawyers at firms like Perkins Coie and Paul, Weiss, Rifkind, Wharton & Garrison. Perkins Coie has sued on allegations that the order violated its constitutional rights, with a judge temporarily blocking parts of the order.

Some companies have policies in place to encourage diversity from their outside law firms. Lucas has requested information on clients that have diversity requirements or preferences for employee staffing since 2019, and the firms’ actions in response to these requirements.

Overall, the EEOC’s efforts to promote diversity, equity, and inclusion in the workplace are crucial in ensuring that all individuals are treated fairly and have equal opportunities for success. It is important for companies to comply with anti-discrimination laws and create a more inclusive work environment for all employees.
