Texas Lawmaker Introduces Bill to Strengthen ICE and Local Law Enforcement Cooperation

In a groundbreaking move, Texas lawmaker Rep. Michael Cloud, a Republican, has unveiled The 287(g) Program Protection Act. This bill aims to enhance collaboration between Immigration and Customs Enforcement (ICE) and state and local law enforcement agencies. The focus of the bill is on 287(g) of the Immigration and Nationality Act, which allows ICE to delegate certain immigration functions to state and local law enforcement officers, including the identification and detention of suspected illegal immigrants.

The Biden administration had paused new entries into the 287(g) program in 2021 and had not approved any new agreements since then. Cloud’s bill seeks to reinforce the stance taken by the Trump administration, requiring the Department of Homeland Security (DHS) to approve any applications by state and local law enforcement within 90 days. If an application is denied, Congress must be notified. Additionally, DHS would need to inform Congress if they intended to terminate an agreement, with provisions for an appeal by the local or state law enforcement agency.

The bill also mandates that DHS provide an annual performance report and recruitment strategies. Rep. Cloud emphasized the importance of restoring law and order to the immigration system, stating that the Biden administration’s policies had undermined border security and flooded the country with illegal immigrants. He expressed confidence that by expanding and protecting the 287(g) program, local law enforcement could partner with ICE to remove illegal immigrants and make communities safer.

The initiative has garnered support from Texas’ Goliad County Sheriff Roy Boyd, who hailed it as a significant step in enhancing cooperation and coordination between law enforcement agencies at all levels. With Republican control of both the House and the Senate, the bill stands a strong chance of passage. Several GOP-backed immigration bills have been introduced in recent days, reflecting the priority placed on addressing illegal immigration by voters.
