Biden’s official X account draws mockery with reference to constitutional amendment that doesn’t exist

President Biden is not slowing down during his final weekend in the White House. Instead, he is advocating for a new amendment to the Constitution that would establish the Equal Rights Amendment (ERA) as the “law of the land.”

In a statement issued by the White House, Biden emphasized the need for the United States to “affirm and protect women’s full equality once and for all.” While his message was clear in the statement, a post on his official X account sparked criticism from users. The post referred to the 28th Amendment to the Constitution, even though the US Constitution currently has only 27 amendments, with the last one ratified in 1992.

The post on X suggesting that the ERA is already part of the Constitution, despite not being the case, led to social media users calling out the president, with some even going as far as labeling him a “dictator.” Critics also brought up Biden’s previous comments about Trump being a “threat to democracy,” accusing him of attempting to “declare” an amendment into existence.

Biden cited the American Bar Association in his statement, arguing that the ERA has met all necessary requirements to be formally added to the Constitution. He expressed agreement with the ABA and leading constitutional scholars, asserting that the Equal Rights Amendment has become a part of the Constitution. However, the National Archives contradicted Biden’s claims in a statement released in December, stating that the ERA cannot be certified as part of the Constitution due to legal and procedural reasons.

The ERA is a proposed amendment to the Constitution that aims to guarantee “equal rights under the law” to all Americans regardless of sex. Biden’s assertion that the 28th Amendment is the law of the land triggered a community note highlighting that the Archivist of the United States has confirmed that the ERA was not ratified, and there is no 28th Amendment.
