Supreme Court denies Trump attempt to stop sentencing in New York v. Trump

The United States Supreme Court has made a decision regarding President-elect Trump’s petition to block his sentencing in New York v. Trump. Trump had filed an emergency petition with the Supreme Court in an attempt to halt his Jan. 10 sentencing, which was scheduled by Judge Juan Merchan.
In a statement released on Thursday night, the Supreme Court stated that the burden of sentencing on the President-Elect’s responsibilities is minimal, as the trial court intends to impose a sentence of ‘unconditional discharge’ following a brief virtual hearing. This means that the sentencing in New York v. Trump can proceed as planned, with Trump expected to appear virtually for the proceeding on Friday at 9:30 am.
Judge Merchan had set Trump’s sentencing date after a jury found him guilty of falsifying business records in the first degree as part of Manhattan District Attorney Alvin Bragg’s investigation. Trump has pleaded not guilty to all charges and has appealed the ruling, although his appeal was rejected by Merchan last week.
Trump’s legal team had filed a motion with the Supreme Court requesting a stay of the pending criminal proceedings in New York until the final resolution of Trump’s appeal on presidential immunity. They argued that New York prosecutors had improperly admitted evidence related to official presidential acts during the trial, disregarding the Supreme Court’s ruling on presidential immunity.
Despite these arguments, the Supreme Court upheld the lower court’s decision, allowing the sentencing to proceed. However, it is important to note that Judge Merchan has stated that he is unlikely to impose a sentence of incarceration on Trump, instead opting for an ‘unconditional discharge,’ which means no punishment will be imposed.
President-elect Trump is set to be sworn in as the 47th President of the United States on Jan. 20. Throughout the case, Trump has maintained his innocence and criticized it as a political attack orchestrated by Democrats to undermine his election campaign.
