Dem DA lets off illegal charged with strangulation, kidnapping

A Democratic prosecutor in Fairfax County, Virginia, has come under fire for dropping a felony charge against a twice-deported illegal immigrant accused of strangulation and kidnapping. Wilmer Osmany Ramos Giron, a Guatemalan national, was facing serious charges after allegedly assaulting his ex-wife during an argument. The victim reported that Ramos Giron prevented her from leaving, choked her, and brandished a knife.

Despite the severity of the allegations, Commonwealth’s Attorney Steve Descano opted to drop the felony charge against Ramos Giron and allowed him to plead guilty to a lesser charge of brandishing a blade, a misdemeanor. This decision has sparked outrage among local leaders and community members who believe that Descano is prioritizing the interests of illegal immigrants over public safety.

It is worth noting that Ramos Giron is in the country illegally and has been deported twice before. He also has a prior federal conviction for a gun crime, as confirmed by Immigration and Customs Enforcement (ICE). An ICE detainer has been filed against him, indicating that he may be subject to deportation once again.

Virginia Attorney General Jason Miyares, a Republican, condemned Descano’s actions, stating that individuals who are in the country illegally and have committed violent crimes should not be treated more leniently than legal citizens. He criticized Descano for prioritizing the interests of illegal immigrants over the safety and well-being of the community.

Additionally, Fairfax County Criminal Justice Advisory Board member Sean Kennedy expressed his dismay over Descano’s decision, describing it as “appalling” that the prosecutor would protect a violent offender simply because he is illegally present in the country. Kennedy raised concerns about the existence of a two-tier justice system in Fairfax County, where illegal immigrants are seemingly given preferential treatment.

The controversy surrounding Descano’s plea deal with Ramos Giron highlights the complex and contentious issues surrounding immigration enforcement and criminal justice. As the debate continues, it is essential to prioritize public safety and uphold the rule of law, regardless of an individual’s immigration status.
