President Donald Trump to sign executive order instructing federal agencies to hunt down regulations that violate Constitution

President Donald Trump is set to sign an executive order that will require federal agencies to evaluate all regulations that could potentially violate the Constitution. This move is part of the administration’s ongoing efforts to cut down on red tape and ensure that government regulations do not harm the American people.
The executive order, described by senior administration officials as a first of its kind, will mandate agencies to compile a list of regulations that could potentially violate the Constitution or cause harm. This list will be submitted to the Office of Management and Budget (OMB) within the next 60 days for review.
The Office of Information and Regulatory Affairs at OMB and the newly established Department of Government Efficiency (DOGE) will be tasked with spearheading this evaluation process. Officials at federal agencies will identify regulations that may be unconstitutional and share them with OMB for further assessment.
After the 60-day period, OMB will review the list of regulations and make individual determinations on which ones are unconstitutional. The process of repealing these regulations will then be initiated on a case-by-case basis.
The creation of DOGE underscores the administration’s commitment to eliminating government waste, fraud, and excessive spending. This executive order comes on the heels of recent Supreme Court decisions that have curtailed federal agencies’ overreach in enforcing regulations beyond their jurisdiction.
One such case involved the EPA’s attempt to enforce regulations on private property under the Clean Water Act in Sackett v. EPA. The Supreme Court ruled that the law only applies to waters that are relatively permanent, standing, or continuously flowing bodies of water, limiting the EPA’s authority in this regard.
This latest executive order builds on the administration’s previous efforts to streamline regulations. In January, Trump signed an executive order requiring agencies to eliminate 10 regulations for every new one introduced. This move is part of a broader deregulation campaign aimed at reducing bureaucratic hurdles and fostering economic growth.
Trump has pledged to continue his deregulatory agenda, surpassing even the efforts of his first term. Previous initiatives to cut regulations resulted in agencies eliminating five and a half regulations for every new one implemented.
The administration’s focus on regulatory reform reflects its commitment to promoting efficiency, accountability, and constitutional compliance within the federal government.
