Mace’s resolution states that “a Member, Delegate, Resident Commissioner, officer, or employee of the House may not use a single-sex facility (including a restroom, changing room, or locker room) in the Capitol or House Office Buildings, other than those corresponding to the biological sex of such individual,” with enforcement by the House sergeant-at-arms.

Delaware state Sen. Sarah McBride, a Democrat who identifies as transgender, was elected to the U.S. House of Representatives during the 2024 election. In response to Mace’s resolution, McBride, a biological male, emphasized that individuals should respect each other’s differences and engage respectfully in the workplace. McBride, who will be the first openly transgender member of Congress, expressed the importance of focusing on critical issues like affordable housing, healthcare, and childcare, rather than engaging in divisive culture wars.

Greene, in a video, asserted that McBride, as a biological male, should use the men’s restroom and not women’s spaces. She also expressed her support for a resolution that would ban men from women’s restrooms in all taxpayer-funded facilities.
