Court filing reveals new details on Trump’s transgender ban

The Trump administration’s new policy regarding transgender individuals in the military has been revealed in an internal Pentagon memo, which states that U.S. service members who are transgender or exhibit gender dysphoria are prohibited from military service unless they obtain an exemption. The memo outlines that such service members may be considered for a waiver on a case-by-case basis, provided there is a compelling Government interest.

According to the memo, service members who have a current diagnosis, history of, or exhibit symptoms consistent with gender dysphoria are disqualified from military service. Additionally, those who have a history of cross-sex hormone therapy or sex reassignment surgery as treatment for gender dysphoria or in pursuit of a sex transition are also disqualified.

The memo further specifies the requirements for obtaining an exemption. A soldier must demonstrate 36 consecutive months of stability in their sex, never have attempted to transition to any sex other than their own, and be willing to adhere to standards associated with their sex.

The Pentagon’s transgender ban is currently facing legal challenges, with the Trump administration filing a complaint against the presiding judge, Ana Reyes, accusing her of potential bias and misconduct during proceedings related to transgender individuals serving in the military. The case was brought by LGBTQ groups challenging the executive orders barring transgender individuals from military service.

The complaint alleges instances of misconduct by Judge Reyes during the proceedings and raises concerns about her impartiality. It also requests appropriate action to address these violations and investigate whether they represent a pattern of misconduct requiring remedial measures.
