Florida asks SCOTUS to allow enforcement of controversial immigration law

Florida’s attorney general is seeking to enforce a controversial immigration law that criminalizes the arrival or reentry of illegal migrants to the state, sparking a high-stakes legal battle with immigration advocates. Attorney General James Uthmeier has asked the Supreme Court to allow the state to implement Senate Bill 4C, which targets undocumented immigrants who have been deported or denied entry to the U.S.

The law was initially blocked by a federal judge in Miami and the 11th U.S. Circuit Court of Appeals refused to lift the injunction, prompting Uthmeier to seek emergency relief from the Supreme Court. Uthmeier argues that the injunction is detrimental to both state and national interests, as illegal immigration continues to pose a threat to Florida.

Despite the federal court’s ruling that the law may be unconstitutional and conflicts with existing federal laws, Uthmeier maintains that there is no conflict with federal law in SB 4C. The judge even initiated contempt proceedings against Uthmeier for allegedly violating the injunction by allowing police to make arrests under the law.

Uthmeier is urging the Supreme Court to reverse the lower court rulings, emphasizing that the law is designed to protect against the violence, drugs, and trafficking fueled by unauthorized aliens entering Florida. Without Supreme Court intervention, Florida and its citizens will be unable to address the serious harms of illegal immigration for years to come.

The emergency appeal from Florida’s attorney general comes as the Supreme Court is already considering several emergency applications from the Trump administration on issues like birthright citizenship, universal injunctions, and executive branch authorities.
