Anglican Diocese of N.S., P.E.I. adopts pledge banning inappropriate use of NDAs

The recent resolution passed by the Anglican Diocese of Nova Scotia and Prince Edward Island regarding the misuse of non-disclosure agreements marks a significant step forward in the fight against abuse and misconduct within religious organizations. Julie Macfarlane, the head of Can’t Buy My Silence Canada, expressed her delight at the news, stating that this decision sets a positive example for other Christian groups in Canada.

The resolution, which was unanimously approved by the diocese, prohibits the use of NDAs unless specifically requested by a complainant in cases involving sexual harassment, misconduct, abuse, discrimination, retaliation, or bullying. This move is particularly impactful given the history of NDAs being used to silence victims of abuse within the church.

As a survivor of sexual abuse by an Anglican minister, Macfarlane has been working with the Anglican Church for many years to advocate for justice and accountability. She hopes that the diocese’s commitment to banning inappropriate NDAs will inspire other religious organizations to follow suit.

While Macfarlane commends the diocese for taking this important step, she notes that there was an amendment made to the original pledge that she would not have recommended. The change allows for NDAs to be used if requested by the complainant, which Macfarlane believes is unnecessary. She emphasizes that a victim-protective clause can provide protection without requiring the victim to remain silent about their experiences.

Despite this amendment, Macfarlane views the diocese’s resolution as a positive step forward in promoting transparency and accountability within the church. The decision sends a clear message to survivors of abuse that their voices will be heard and respected.

In a statement issued by Can’t Buy My Silence, diocese member Cynthia Pilichos expressed her support for the ban on inappropriate NDA use, emphasizing the organization’s commitment to justice, respect, and dignity for all. She believes that this pledge is a significant stride towards ensuring accountability and preventing the silencing of victims.

Overall, the resolution passed by the Anglican Diocese of Nova Scotia and Prince Edward Island represents a promising development in the ongoing efforts to address abuse and misconduct within religious institutions. By pledging to refrain from misusing NDAs, the diocese is taking a crucial step towards creating a safer and more transparent environment for all members.
