DOJ asks public to report visa discrimination against American workers

The Department of Justice is asking individuals to report any instances of illegal visa practices that may be disadvantaging American workers.
Citizens are being encouraged to flag job advertisements that appear to show a preference for individuals on seasonal or H-1B visas, labeling them as potentially “discriminatory.”
“Are you an American citizen who has been affected by unfair preferences for foreign workers, such as H-1B visas? Follow the link. This platform also allows for reporting incidents of human trafficking involving immigrant workers and cases of Title VII employment discrimination,” stated Harmeet Dhillon, assistant attorney general for civil rights at the DOJ, in a recent post.

The Department of Justice is also soliciting tips related to potential human trafficking violations within temporary visa programs.
H-1B visas were a topic of debate earlier this year, with critics arguing that they hinder opportunities for American workers in sectors like technology, while proponents maintain that they contribute to the economy.
“The primary purpose of the H-1B visa program and other guest worker initiatives is not to hire the most skilled individuals, but rather to replace well-paid American jobs with lower-wage foreign workers,” commented Sen. Bernie Sanders, I-VT, in a post on X in January. “The cheaper the labor they hire, the more money the billionaires make.”

For the fiscal year 2026, H-1B visas have already reached the legal petition cap, with 65,000 allotted for standard applicants and an additional 20,000 reserved for those with advanced degrees, according to U.S. Citizenship and Immigration Services. These visas are primarily intended for skilled workers in fields such as architecture, engineering, mathematics, physical sciences, social sciences, medicine, education, business, accounting, law, theology, and the arts, as outlined on the agency’s website.

Florida Governor Ron DeSantis has criticized the H-1B visa program, labeling it as a “scam” during an interview with Fox News Channel’s Laura Ingraham.
“Certain companies are exploiting the system. Some of these companies are laying off American workers in large numbers while simultaneously hiring new H-1B visa holders and renewing existing ones,” DeSantis remarked.

“There was a misconception that we were attracting the best talent from around the world. In reality, that’s not the case with H-1Bs. A majority of them come from a single country, India. There is a whole industry profiting from this system,” he added.
Significant visa reform is currently underway in the U.S., with the Trump administration conducting a comprehensive review of all 55 million visas to ensure compliance with the law.
“The department’s continuous vetting process encompasses all of the more than 55 million foreign nationals holding valid U.S. visas,” stated a spokesperson from the State Department to Fox News Digital last week.
A visa may be revoked by the department in cases of overstays, criminal activity, threats to public safety, involvement in terrorist activities, or support for terrorist organizations.
