Trans athlete battle: Texas judge strikes down injunction seeking gender testing

A recent ruling by a Texas judge has denied an injunction seeking mandatory gender testing for trans athletes in women’s sports. The hearing, presided over by Lubbock County Judge Les Hatch, was brought about by Texas Attorney General Ken Paxton, who sued the NCAA over its gender eligibility policy.
The NCAA revised its policy in February to comply with President Donald Trump’s executive order banning trans athletes from women’s and girls’ sports. The new policy states that biological male athletes are ineligible to compete in the women’s category. However, Paxton and women’s rights activists argued that the policy does not go far enough in keeping trans athletes out of women’s sports, and mandatory gender testing is necessary for enforcement.
Paxton was joined by three former women collegiate athletes who were impacted by trans inclusion. They shared their experiences of having to compete with trans athletes and argued for the need for gender testing. Despite their testimonies, Judge Hatch ruled against the injunction.
The NCAA provided a statement in response to the ruling, stating that their policy aligns with the Keeping Men Out of Women’s Sports Executive Order. President Trump had praised the NCAA’s policy change in a social media post following the amendment.
Critics of the NCAA’s policy have raised concerns about the reliance on birth certificates, as some states allow for birth certificates to be amended to change a person’s birth sex. However, the NCAA has stated that amended birth certificates will not be accepted as sufficient evidence for competing in women’s sports.
The ruling was a disappointment for the athletes and activists involved in the case, but they remain committed to fighting for their cause. Brooke Slusser, one of the athletes impacted by the policy, is engaged in multiple lawsuits related to the issue.
