Federal appeals court denies Trump request to reinstate birthright citizenship order

The Ninth Circuit Court of Appeals has delivered a blow to the Trump administration by rejecting their request for emergency relief from an injunction blocking the birthright citizenship executive order. This latest legal defeat marks a string of setbacks for the administration in their efforts to implement the controversial policy.
In a unanimous ruling, the judges found that the administration did not provide sufficient evidence to demonstrate a strong likelihood of success on the merits of the appeal. As a result, the emergency request was denied by a 3-0 vote.
“The emergency motion for a partial stay of the district court’s February 6, 2025 preliminary injunction is denied,” the court stated in their decision.
The ruling comes on the same day that President Donald Trump’s birthright citizenship executive order was scheduled to take effect. Multiple district courts have previously blocked the order, prompting the administration to seek emergency relief in an attempt to overturn the injunction.
