Tardiness Continues to Plague Via Rail Due to CN Rail Dispute

Tardiness has become a common issue at Via Rail, but the problem has escalated to unprecedented levels in a crucial corridor as passenger trains are forced to slow down at numerous rail crossings operated by CN Rail. The ongoing dispute between Via and CN has only exacerbated the situation, leading to a significant increase in late arrivals.

Recent data obtained by Radio-Canada reveals that the situation has worsened since the onset of the conflict over rail crossings between the two railway companies. CN recently imposed a new requirement that Via Rail conductors visually confirm the lowering of safety barriers at each rail crossing, leading to delays in 80% of trips lasting more than 10 to 15 minutes in February along the Quebec City-Windsor corridor, where the majority of Via trains operate. In January, 67% of trains experienced delays in the same corridor.

The situation is even more dire between Quebec City and Ottawa, with 94% of trains experiencing delays last month and 86% in January. Some delays were attributed to heavy snowfall. In contrast, in 2023, 60% of trains on the Quebec City-Windsor corridor arrived on time, according to Via Rail data.

Via Rail is hopeful that the federal government will intervene in the dispute, as the ongoing conflict with CN is not only disrupting thousands of passengers but also tarnishing the reputation of rail service in the country. Via spokesperson Karl Helou emphasized the urgency of lifting the restrictions imposed by CN and called for detailed information and analysis supporting the decision to be made public promptly.

The dispute stems from the number of axles on Via Rail’s new Venture trains, which do not meet CN’s requirement of 32 axles to ensure the activation of safety barriers and signals at rail crossings. CN has emphasized that safety is its top priority and plans to present its arguments in court, as the case is currently before the Superior Court of Québec. Via Rail has requested the restrictions to be lifted, stating that the current situation does not pose additional risks at rail crossings.

The Bloc Québécois has urged the federal government to intervene and lift the restrictions imposed by CN unless concrete evidence is provided to justify their impact on public safety. Bloc MP Xavier Barsalou-Duval emphasized the need for a safe, efficient, and reliable rail service for passengers. The office of Transportation Minister Anita Anand has yet to respond to the Bloc Québécois’ letter.

Transport Canada stated that it does not have intervenor status in the legal dispute between CN and Via Rail but emphasized that any regulatory action would prioritize railway security. As the dispute continues to affect the punctuality of Via Rail services, passengers are left hoping for a swift resolution to ensure a smoother travel experience.
