Loudoun schools referred to Justice Department after Title IX investigation

A recent investigation by Virginia Attorney General Jason Miyares has shed light on a controversial transgender bathroom incident that took place at Loudoun County Public Schools (LCPS) two years ago. The investigation looked into allegations of Title IX violations, unlawful retaliation, and viewpoint discrimination after three boys raised concerns about sharing a locker room with a female student who identifies as male.
Miyares announced the completion of his probe and referred LCPS to the Justice Department and the Department of Education. He expressed concern over the misuse of authority by the school district, where students were allegedly targeted for expressing discomfort over the situation. Miyares emphasized the importance of protecting students’ rights to free speech, free thinking, and living according to their conscience without fear of retaliation.
Assistant Attorney General Harmeet Dhillon echoed Miyares’ sentiments, stating that sex-based discrimination and student safety are top priorities for the Department of Justice. Dhillon highlighted the impact of “transgender” policies in Loudoun County schools, noting that they are stripping students of their fundamental rights.
The investigation found that LCPS initiated a Title IX probe into the three male students at Stone Bridge High School who had raised objections to a policy allowing students to use facilities based on their gender identity. The boys also expressed concerns about a biological female student who allegedly recorded them in the locker room.
In response to the referral, a representative for LCPS stated that the district is focused on following applicable law and ensuring student safety. The district did not receive official communication from Miyares regarding the investigation findings and was unable to participate meaningfully in the probe.
The Department of Education declined to confirm complaints related to the investigation. LCPS had previously come under scrutiny after a father accused the school board of covering up his daughter’s sexual assault by a biological male who identified as female.
The investigation highlights the ongoing challenges faced by schools in addressing transgender policies and ensuring the safety and rights of all students. As the probe continues, it remains to be seen how the Justice Department and the Department of Education will respond to the findings and take action to address the issues raised by the investigation.
