Experts reveal how Trump’s next move could impact Biden-era regulations on nicotine

President Trump’s “nicotine freedom crusade” is gaining momentum as he rolls back Biden-era policies related to nicotine and tobacco products. One key rule that experts believe could be reversed is the proposal from Biden’s FDA to limit the level of nicotine in cigarettes and certain other combusted tobacco products.
The FDA’s proposed rule would restrict cigarettes and certain tobacco products to no more than 0.7 milligrams of nicotine per gram of tobacco, with the goal of making them minimally or nonaddictive. While the FDA claimed that the rule would not ban cigarettes, critics argue otherwise and are hopeful that Trump will continue his push for nicotine freedom by overturning the rule.
Rich Marianos, former assistant director of the ATF, expressed his support for Trump’s efforts, stating that Biden’s tobacco policies have been ineffective and have led to the growth of criminal markets. Peter Brennan, Executive Director of the NECSEM, warned that prohibitionist tobacco policies harm small businesses by driving sales into the illicit market.
Since taking office, President Trump has already taken steps to withdraw a proposed rule to ban menthol cigarettes, a move that was intended to become a reality under the Biden administration. The removal of FDA Tobacco Director Brian King, who was seen as a key figure behind the anti-smoking efforts, was also seen as a positive development by experts.
The next logical step for Trump’s administration, according to a Republican strategist, would be to officially repeal the Biden-era rule on banning low nicotine products. This would deal a final blow to Biden’s “war on nicotine” and be a significant victory for working-class Americans who support Trump.
The perceived “war on nicotine” under Biden, along with the influx of illicit Chinese vapes into the market, is believed to have negatively impacted his presidential campaign. By reversing Biden’s proposed rule on banning cigarettes, Trump could further solidify his support among his base.
As Trump continues his nicotine freedom crusade, it remains to be seen how the FDA will respond to these potential policy changes. The fight against excessive regulations and prohibitions on tobacco products is ongoing, and Trump’s administration is poised to make significant strides in this area.
